These terms and conditions set forth the usage requirements for the online shop (hereinafter referred to as "the Service") provided by Nishino Co., Ltd. on this website.
Registered users (hereinafter referred to as "Users") must use this service in accordance with these Terms and Conditions.

Article 1 (Applicable)

1. These Terms and Conditions shall apply to all relationships between the User and the Company regarding the use of the Service.

Article 2 (User Registration)

1. In this service, the registration applicant shall complete the registration by agreeing to these terms, applying for registration in the manner specified by our company, and receiving notification of approval from our company.
2. If our company determines that the applicant for registration has any of the following reasons, we may not approve the application for registration, and we shall have no obligation to disclose the reasons.

   (3) Any other case in which the Company determines that registration is not appropriate.

Article 3 (Management of User ID and Password)

1. Users shall manage their user ID and password for this service at their own responsibility.
2. Users may not transfer or lend their user ID and password to any third party, nor share them with any third party under any circumstances.
   When the combination of user ID and password matches the registered information and is logged in, it is considered to be used by the user who registered that user ID.
3. The company shall not be liable for any damages arising from the use of the user ID and password by a third party, except in cases of intentional misconduct or gross negligence on the part of the company.

Article 4 (Sales Contract)

1. In this service, a sales contract is established when the user makes a purchase application to us, and we notify the user of our acceptance of that application.
   The ownership of the product will be transferred to the user when the company delivers the product to the delivery company.
2. The company may terminate the sales contract mentioned in the previous paragraph without prior notice to the user if the user falls under any of the following reasons.
   (1) If the user violates these terms and conditions
   (2) If the delivery of the product is not completed due to an unknown address or a long absence
   (3) Any other case where it is deemed that the relationship of trust between the Company and the User has been damaged.
3. The payment methods, delivery methods, cancellation methods for purchase applications, and return methods related to this service will be determined separately by our company.

Article 5 (Intellectual Property Rights)

The copyright or other intellectual property rights of the product photos and other content provided by this service (hereinafter referred to as "Content") belong to our company and legitimate rights holders such as content providers, and users may not reproduce, reprint, modify, or otherwise use these without permission.

Article 6 (Prohibited Items)

When using this service, users must not engage in the following acts.

1. Acts that violate laws or these terms, precautions for using this service, precautions for shopping in this service, and other terms and conditions.
2. Actions that harm the rights, interests, reputation, etc. of our company or other third parties.
3. Actions that violate laws and regulations or public order and morals
4. Any activity related to criminal activity

Article 7 (Suspension of provision of the Service, etc.)

   (2) When it becomes difficult to provide the Service due to force majeure such as earthquake, lightning, fire, power outage or natural disaster.
   (3) When a computer or communication line is stopped due to an accident
   (4) Any other case in which the Company determines that it is difficult to provide the Service.
2. Our company shall not be liable for any disadvantages or damages incurred by users or third parties due to the suspension or interruption of the provision of this service, regardless of the reason.

Article 8 (Restrictions on Use and Cancellation of Registration)

1. The company may restrict the use of all or part of this service for the user, or cancel the user's registration, without prior notice, in any of the following cases.
   (1) If you violate any of the provisions of these Terms and Conditions
   (2) If it is discovered that the registered information contains false facts.
   (3) If the credit card registered by the user as a payment method is suspended.
   (4) In the event of failure to pay fees, etc.

2. The Company shall not be liable for any damages incurred by the User as a result of any actions taken by the Company pursuant to this Article.

Article 9 (Withdrawal)

If a member wishes to cancel their membership, they must complete the cancellation procedure themselves.
Your membership will be cancelled after you have completed the required cancellation procedures.

Article 10 (Disclaimer of Warranties and Disclaimers)

1. Our company does not guarantee that this service is free from any defects (including defects, errors, or bugs related to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, security, and infringement of rights, etc.) in fact or in law.
2. We shall not be liable for any damages incurred by the user as a result of this service.

3. Our company shall not be liable for any transactions, communications, or disputes that arise between users and other users or third parties in relation to this service.

Article 11 (Changes to Service Content, etc.)

Our company may change the content of this service or discontinue the provision of this service without notifying users, and we shall not be liable for any damages incurred by users as a result.

Article 12 (Changes to Terms of Use)

The company may change these terms at any time without notifying the user if it deems necessary.
If a user starts using the service after the changes to these terms, they will be deemed to have agreed to the revised terms.

Article 13 (Handling of Personal Information)

1. Member information will be managed by our company.

Article 15 (Prohibition of Transfer of Rights and Obligations)

Article 16 (Governing Law and Jurisdiction)

1. The interpretation of these Terms and Conditions shall be governed by Japanese law.
   Furthermore, the application of the United Nations Convention on Contracts for the International Sale of Goods shall be excluded with respect to this Service.
2. In the event of a dispute regarding this service, the court having jurisdiction over the location of our head office shall be the exclusive agreed jurisdiction court.
